  • There are multiple ways: through family, employment, or the visa lottery. A U.S. citizen or green card holder may sponsor an immediate relative, such as a child, parent, sibling, or spouse, for a green card. The process involves filing a Form I-130 petition and then filing a green card application once USCIS approves the petition. There are no waiting lists or limits for immediate family members Applicants must have a permanent job offer in the US from an employer participating in the application process. Preference is given to applicants with greater education, training and ability. The United States government creates up to 50,000 immigrant visas each year through the Diversity Visa Lottery. This program aims to ensure that the United States remains open to countries with low immigration rates.

  • There are typically two ways to receive permanent residency, and it depends on how the immigrant spouse entered first. If I enter with a visa, the process is faster and more direct; If I enter without a visa, the process is slower and requires consular processing, typically, to present the waiver for accumulated illegal presence.

  • The detainee must prove that he is not a danger to society and that there is no risk of flight; You can present evidence such as letters of support from family and friends, ties to the community such as American children, American wife or husband, tax returns, among others. Bail must be requested affirmatively through an attorney.
